Buying luxury property in Spain is often driven by emotion. Architecture and location play a decisive role in the buyer's decision. Just in the higher market segment, however, there is a risk that aesthetics mask technical and legal realities.
At Confianz, we therefore emphasise the importance of integrated due diligence: legal as well as construction. Engaging an architect or construction expert is an essential part of a careful purchase decision.
1. Technical analysis beyond aesthetics
Luxury properties are characterised by refined finishes, but visual perfection does not guarantee structural quality. Structural problems can be masked by high-quality materials or recent cosmetic interventions.
An architect or technical expert's assessment includes:
- the stability and supporting structure of the building;
- The condition of the roof and facades;
- moisture problems and insulation;
- the quality and conformity of technical installations (HVAC, home automation, pool technology).
Where the buyer mainly sees the look, the expert analyses the underlying technical reality.
2. Identification of existing and latent defects
A technical investigation usually results in an objective and documented report beyond what is visible to a non-specialist. This distinguishes between:
- current flaws, requiring immediate repairs;
- latent or potential defects, whose impact only manifests itself in the medium term.
Examples include obsolete roof structures, installations that no longer meet future energy or safety standards, or structural elements with a limited remaining lifespan. Such determinations are essential for correct risk assessment.
3. Legal leverage in negotiations in luxury property in Spain
Technical findings have not only an informative but also a legal function. The expert's report is an important negotiating tool when drawing up the compromise or private sale agreement.
Specifically, this may enable the buyer to:
- negotiate a price reduction proportionate to the necessary repair costs;
- or specific repairs to be contractually imposed on the seller before the execution of the authentic deed;
- or include suspensive or resolutory conditions.
Without technical due diligence, the property is usually purchased “in the state it is in”, with the result that the financial risk of defects falls entirely on the buyer. The time limit to invoke hidden defects is very short when reselling: only 6 months.

4. When does a technical investigation take place?
Ideally, a technical inspection should take place at the stage between reservation and signing the private sale agreement.
With a reservation, you take an option on the property for a certain period of time, usually 20 - 30 days. Within that option period, Confianz can carry out legal checks and a technical expert or architect can examine the property.
Thus, have sufficient contractual leeway to formulate conditions. Once the compromise is signed, the sale is in principle final and it becomes considerably more difficult legally to still invoke technical shortcomings.

Conclusion: investing in legal certainty
The cost of a technical expert rarely outweighs the financial and legal risk of a wrong purchase in the luxury segment. A thorough technical analysis contributes to legal certainty and prevents a dream investment from turning into a source of disputes.
