When is holiday rental in Murcia?

Once you offer a fully furnished property for a short stay for a fee, it is considered a tourist activity. The government assumes regular rentals if you:

  • Advertising through any channel.
  • OR let the property two or more times in a calendar year for a total duration of more than one month.

The basics: The Declaración Responsable

At the heart of the legislation in Murcia is the 'Declaración Responsable'. This is an official document in which you, the owner, declare that your property meets all legal requirements. You do not have to wait for an inspection to start renting; you start based on your own responsibility. The government does carry out checks and there are severe consequences if your declaration is found to be incorrect.

Requirements for your Home: The Checklist

Before you can file the Declaración Responsable, your property must meet a number of administrative and material requirements.

Administrative Requirements:

  • Licencia de Ocupación: This document is essential and proves that your property meets habitability standards.
  • Liability insurance (Seguro de Responsabilidad Civil): Insurance covering damages to third parties for a minimum of €300,000 is mandatory.
  • Energy performance certificate (EPC): As in Belgium, an EPC is mandatory.
  • Permission VME: Permission from the Co-owners' Association is required.

Material Requirements:

  • Furnishing: The property must be fully furnished and equipped for immediate use.
  • Air conditioning: Heating in all rooms and air conditioning in bedrooms and living space are mandatory.
  • First-aid kit: A 'botiquín de primeros auxilios' must be present.
  • Tourist information: You should offer maps and information about the area.
  • Complaint forms: Official 'Hojas de Reclamaciones' should be available.
  • Emergency number: A 24/7 emergency phone number should be clearly visible.

The Process and Duties after Registration

  1. Application: Collect the necessary documents and submit the completed Declaración Responsable to the 'Registro de Empresas y Actividades Turísticas de la Región de Murcia'.
  2. Registration number: After processing, you will receive an official registration number (e.g. VV.MU.XXX-X). You are required to state this number in all advertising and on all rental platforms.
  3. National Number: Since July 2025, in addition to the regional number, a national registration number will also be required if you rent through booking sites.
  4. Guest registration: You are required to register the identity details of every guest over 16 years old and forward them to the police or Guardia Civil within 24 hours of arrival. This is a national rule with zero tolerance.
  5. Pricing: Prices must be clearly and all-in advertised. Hidden extra charges are not allowed.
