But for a long time, the severity of the authorities\u2019 response when something went wrong depended on the sector. Enforcement in environmental cases was handled differently from that for planning offences. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To tackle this proliferation of procedures, on <strong>1 April 2026<\/strong> the new<strong> Flemish Enforcement Framework Decree (KVH) <\/strong>has come into force. This decree is radically reshaping the world of enforcement and harmonising the rules governing, amongst other things, urban planning and the environment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">What does this mean in practical terms for you as a citizen, business owner or property owner? We\u2019ve set out the key changes below.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"> 1. A single, standardised language and equal powers<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">No more confusion over terminology. The decree standardises the terminology across all policy areas. In addition, all Flemish inspection services (whether they relate to the Environment, Immovable Heritage or the Environment) <strong>the same supervisory and investigative powers<\/strong>. This makes cross-sector cooperation between inspectors much easier and ensures that, as a member of the public, you know more quickly what your rights and obligations are during an inspection.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2. Faster fines through administrative channels<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The public prosecutor\u2019s office receives a huge volume of construction-related offences every day. As more serious crimes are often given priority, minor planning offences were regularly dismissed in the past. The new Framework Decree therefore, in line with previous reforms, places further emphasis on\u00a0<strong>a single, standardised administrative penalty procedure<\/strong>. This will enable administrative enforcement to be implemented even more quickly and efficiently. Administrative enforcement will become the norm, whilst criminal enforcement will be the exception.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the public prosecutor\u2019s office decides not to bring criminal proceedings in a case, the Flemish government can now more easily deal with the matter administratively itself. This significantly increases the likelihood that an offence will go unpunished (the so-called \u2018prosecution rate\u2019).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><a href=\"https:\/\/www.confianz.be\/en\/conservation-of-spatially-vulnerable-areas\/\" data-type=\"link\" data-id=\"https:\/\/www.confianz.be\/ruimtelijk-kwetsbare-gebieden-instandhouding\/\">Read more about the approach to tackling unauthorised structures in areas of high environmental sensitivity.<\/a><\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">3. Scope for \u2018soft enforcement\u2019<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Fortunately, the new decree is not purely repressive. Provision has been made explicitly for a more lenient approach, to give citizens the chance to rectify their mistakes. From now on, inspectors can make use of standardised procedures for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Warnings and reminders;<\/li>\n\n\n\n<li>Remedial arrangements: an amicable settlement whereby you are given the opportunity to remedy the situation voluntarily within a specified period, without immediate severe penalties being imposed.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">4. Everything digital (and transparent for the property sector)<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">From now on, all official reports, penalties and remedial decisions will be managed centrally in digital form via the <strong><a href=\"https:\/\/www.vlaanderen.be\/agentschap-justitie-en-handhaving\/handhavingsbeleid-in-vlaanderen\/vlaams-handhavingsplatform\" data-type=\"link\" data-id=\"https:\/\/www.vlaanderen.be\/agentschap-justitie-en-handhaving\/handhavingsbeleid-in-vlaanderen\/vlaams-handhavingsplatform\" target=\"_blank\" rel=\"noopener\">Flemish Enforcement Platform (VHP)<\/a><\/strong>. This also has major implications for the property market. Notaries and estate agents will have easier access to this information. This means that, when a property is transferred, buyers will be able to gain a clearer and more timely insight into any ongoing enforcement measures.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Conclusion<\/strong>: The Flemish Enforcement Framework Decree makes the crackdown on planning offences more efficient, more digital and more uniform.
