For Belgian and Dutch heirs, this is often a complex and time-sensitive procedure, especially when there are <strong>Spanish property, bank accounts or debts<\/strong> are in play.<\/p>\n\n\n\n<p>In this article, we explain the main steps when a Spanish resident dies. We also discuss the points of interest that are essential to <strong>personal liability for debts<\/strong> avoid.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">1. Asset search: what belongs to the estate?<\/h2>\n\n\n\n<p>Settlement always starts with a <strong>thorough asset investigation<\/strong>. This involves identifying which assets and any debts are part of the estate.<\/p>\n\n\n\n<p>In practice, it often involves:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>real estate in Spain<\/li>\n\n\n\n<li>Spanish bank accounts<\/li>\n\n\n\n<li>Belgian or other foreign bank accounts<\/li>\n\n\n\n<li>vehicles (e.g. a car)<\/li>\n\n\n\n<li>mortgages, loans or other registered debts<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p>A complete and correct overview forms the basis for both the <strong>notarised<\/strong> if the <strong>tax<\/strong> handling of the estate.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">2. Determining the heirs<\/h2>\n\n\n\n<p>It is then determined who is legally considered an heir. In many cases, these are the deceased's children, whether or not together with the <strong>surviving spouse<\/strong>.<\/p>\n\n\n\n<p>This is an important step for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Preparation of the notarial estate deed<\/li>\n\n\n\n<li>Spanish inheritance tax declaration<\/li>\n\n\n\n<li>the subsequent registration or sale of Spanish property<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">3. The estate deed<\/h2>\n\n\n\n<p>When preparing the Spanish acceptance deed, there are two fundamental choices:<br><strong>the procedure<\/strong> (with or without a will) and <strong>the method of acceptance<\/strong> (liability for debts).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">A. With or without a will<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>With will<\/strong><br>If there is a valid Spanish or foreign will, the heirs designated in it can directly accept or reject the estate.<\/li>\n\n\n\n<li><strong>Without a will (ab intestato)<\/strong><br>In this case, a <em>Declaraci\u00f3n de Herederos<\/em> (deed of succession) be drawn up. This requires two witnesses.<br>After this deed, a statutory waiting period of 20 days applies, after which only the acceptance deed can be executed.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">B. Mode of acceptance: watch your liability<\/h3>\n\n\n\n<p>When signing the deed, each heir must make a conscious choice:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Pure acceptance<\/strong><br>You accept both assets and debts.<br>If the debts exceed the assets, you are <strong>personally liable<\/strong> with your equity.<\/li>\n\n\n\n<li><strong>Acceptance under privilege of inventory (<em>beneficio de inventario<\/em>)<\/strong><br>Your liability remains limited to the value of the estate. Your private assets remain protected.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>Important: strict legal deadlines<\/strong><br>Those who opt for acceptance under the privilege of estate planning must strictly observe the legal deadlines. If not, one is automatically deemed <strong>to have accepted purely<\/strong>, with all the risks involved.<\/p>\n\n\n\n<p>Key deadlines:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Request inventory<\/strong>: Within 30 days of knowing you are an heir (if you are already managing the assets).<\/li>\n\n\n\n<li><strong>The so-called 1005 request<\/strong>: a creditor can compel you through the notary to decide within 30 calendar days. No response = pure acceptance.<\/li>\n\n\n\n<li><strong>Inventory<\/strong>: start within 30 days of convocation and completion within 60 days.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p>An incomplete inventory or concealment of assets leads to loss of protection.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">4. Spanish inheritance tax return<\/h2>\n\n\n\n<p>Following the acceptance deed, the <strong>Spanish inheritance tax<\/strong> stated.<\/p>\n\n\n\n<p>For non-residents, a key issue here is that they are allowed to choose the <strong>regional tax regime<\/strong>.
