A transition period is foreseen until<strong> 1 July 2025<\/strong> allowing time for the government, digital platforms and landlords to adapt.<\/p>\n\n\n\n<p>A <a href=\"https:\/\/boe.es\/boe\/dias\/2024\/12\/24\/pdfs\/BOE-A-2024-26931.pdf\" data-type=\"link\" data-id=\"https:\/\/boe.es\/boe\/dias\/2024\/12\/24\/pdfs\/BOE-A-2024-26931.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">registration requirement<\/a> will apply to owners who rent out furnished residential properties through short-term contracts. Here is everything you need to know about these new regulations.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Which leases are subject to the registration requirement?<\/h4>\n\n\n\n<p>The registration requirement applies if you want to rent out your property on a short-term basis and advertise it online. Short-term basis means residential furnished rental for non-permanent occupation.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong><a href=\"https:\/\/www.confianz.be\/en\/common-rent\/\" data-type=\"link\" data-id=\"https:\/\/www.confianz.be\/gemene-huur\/\">Seasonal rental<\/a><\/strong>, for example, for workers or students temporarily staying in a region.<\/li>\n\n\n\n<li><strong>Holiday rental<\/strong>, such as holiday homes and flats for tourists.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p><strong><a href=\"https:\/\/www.confianz.be\/en\/national-registration-requirement-for-booking-platforms\/\" data-type=\"link\" data-id=\"https:\/\/www.confianz.be\/nationale-registratieverplichting-voor-bookingplatformen\/\">Update June 2025: a registration requirement only applies if you offer the property for rent via a booking platform where the transaction is also concluded; i.e. where a lease is finalised.<\/a><\/strong><\/p>\n\n\n\n<p>Important: <strong>each accommodation must be individually registered<\/strong>. For example, if you rent out several rooms separately in one property, you should <strong>separate registration for each room<\/strong> request.<\/p>\n\n\n\n<p>Hotels and campsites are not targeted. <\/p>\n\n\n\n<p>Rental of boats or ships, for example, should also be registered, but this article will be limited to real estate.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">In which regions does this obligation apply?<\/h4>\n\n\n\n<p>These regulations apply <strong>national<\/strong> and is in force throughout <strong>Spain<\/strong>, regardless of the autonomous region.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">How do I register my property?<\/h4>\n\n\n\n<p>To register your property, complete the following steps:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>You register your property via the <strong>digital counter<\/strong>: <em>Ventanilla \u00danica Digital de Arrendamientos <\/em>(online platform of the <a href=\"https:\/\/sede.registradores.org\/sede\/sede-corpme-web\/home\" target=\"_blank\" data-type=\"link\" data-id=\"https:\/\/sede.registradores.org\/sede\/sede-corpme-web\/home\" rel=\"noreferrer noopener\">property register<\/a>). You will need your<a href=\"https:\/\/www.sede.fnmt.gob.es\/certificados\/persona-fisica\/obtener-certificado-video-identificacion\/configuracion-previa\" data-type=\"link\" data-id=\"https:\/\/www.sede.fnmt.gob.es\/certificados\/persona-fisica\/obtener-certificado-video-identificacion\/configuracion-previa\" target=\"_blank\" rel=\"noreferrer noopener\"> Spanish digital signature<\/a> (<em>certificado digital <\/em>or <em>cl@ve) <\/em>needed.<\/li>\n\n\n\n<li>You will share the following information per accommodation unit: address, property registration code ( <em>C\u00f3digo Registral \u00danico<\/em>), the cadastral reference, type of accommodation, type of property (your own home, a second residence or other type), type of rental (holiday or seasonal rental), maximum number of occupants, the rental licence of the autonomous region, the consent of the co-owners' association, the category of rental for tourism purposes and\/or category of non-tourism purposes.<\/li>\n\n\n\n<li>If you are a natural person, you will share the following information: your full name, your DNI or NIE number, your address, your phone number and your e-mail address.<br>If you rent through a company, share: the company name, the company number, the name of the director, the registered office, a telephone number and an e-mail address.<\/li>\n\n\n\n<li>After entering these details, you will immediately and automatically receive a registration number for each type of rental. You may therefore receive a registration number for tourist rentals and a number for non-tourist rentals. <\/li>\n\n\n\n<li>If incorrect information is uploaded, the award may be denied, after which you can appeal.<\/li>\n\n\n\n<li>Finally, your application will be checked and assessed. In case of a positive assessment, the registration number will be entered in the property register. In case of a negative assessment, you will have seven days to amend the application. If the application still receives a negative assessment after that, the provisional number will be invalidated.<\/li>\n\n\n\n<li>Every 12 months, you need to submit a new application.<\/li>\n<\/ol>\n\n\n\n<p><\/p>\n\n\n\n<h4 class=\"wp-block-heading\">When can I advertise on online platforms?<\/h4>\n\n\n\n<p>You should pass on the registration number to the online platforms through which you rent out the property. Online platforms are required to conduct random checks on a regular basis.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.confianz.be\/en\/the-new-registration-requirement-for-short-term-rentals-what-does-this-mean-for-rental-platform-in-spain\/\" data-type=\"link\" data-id=\"https:\/\/www.confianz.be\/de-nieuwe-registratieverplichting-voor-kortetermijnverhuur-wat-betekent-dit-voor-verhuurplatform-in-spanje\/\"><strong>Learn more about the monitoring and reporting obligations of online rental platforms in Spain here.<\/strong><\/a><\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Are there any other commitments?<\/h4>\n\n\n\n<p>For seasonal rentals, you should also consider the obligation of the <a href=\"https:\/\/www.confianz.be\/en\/common-rent\/\" data-type=\"link\" data-id=\"https:\/\/www.confianz.be\/gemene-huur\/\">registration of rental deposit.<\/a><\/p>\n\n\n\n<p>In addition, you will also be required to request personal information from your guests\/tourists and pass it on to the police via the <a href=\"https:\/\/sede.mir.gob.es\/opencms\/export\/sites\/default\/es\/procedimientos-y-servicios\/hospedajes-y-alquiler-de-vehiculos\/\" data-type=\"link\" data-id=\"https:\/\/sede.mir.gob.es\/opencms\/export\/sites\/default\/es\/procedimientos-y-servicios\/hospedajes-y-alquiler-de-vehiculos\/\" target=\"_blank\" rel=\"noreferrer noopener\">SES.HOSPEDAJES platform.<\/a> These are the so-called '42-data data' that you need to request and transmit.
